1. Contractual basics
These Terms and Conditions shall apply to all contracts for the sale of goods by the Seller „Waldis Fellshop“ to the Buyer to the exclusion of all other terms and conditions referred to, offered or relied on by the Buyer whether in negotiation or at any stage in the dealings between the parties. With the order the buyer will accept all terms and conditions.
1.1. The content of the order will be saved. The datas of the order will be sent to you via mail. You can also register in our customer log-in area to check the corresponding article numbers.
2. Offer and Conclusion of Contract
2.1 wallis-fellshop.at is offering goods on the Internet, these are, with the exception of deviating information in the article description, usually available at all times and can only be purchased by the customer via the waldis-fellshop.at website and the associated sales systems.
2.2.The customer's orders placed via the Internet are offers to which the customer is fundamentally bound.
2.2.2 Ordering and purchase processing (orders via own domains)
The offers on waldis-fellshop.at's own domains are non-binding. By clicking the button "Buy item or place in the shopping cart" you put the article in a virtual shopping cart. In the shopping cart, the buyer has the opportunity to confirm his details and, if necessary, to correct. In the next 2 steps, the customer can enter his billing or delivery address. In the next step, the customer can select the requested payment method. In the last step, the customer receives an overview of the selected items and shipping costs as well as the data he has provided. There he has the opportunity to correct his information again if necessary.
By clicking the "Send order / Submit order" button, the customer places a binding order for the items in the shopping cart. The purchase contract is concluded with our order confirmation or at the latest with the delivery of the goods. The text of the contract is saved and can be viewed by the customer on our website.
3. Right of withdrawal
If you are acting as a consumer, you can revoke your contract declaration within 14 days without giving reasons in writing (e.g. letter, fax, email) or by returning the goods in their original state (including the original box). We will send you this cancellation policy again separately in text form. This period of 14 days begins on the day after you have received the goods and the cancellation policy in writing. The timely dispatch of the cancellation or the goods is sufficient to meet the cancellation deadline.

In case of an effective cancellation, the mutually received services are to be returned and any benefits (e.g. interest) surrendered. If you can only return the goods to us in a deteriorated condition, you may have to compensate us for the value.
If goods are returned too late or not in original status or packing, the refund can not be effected from our side.
This does not apply if the deterioration of the goods is solely due to their inspection - as you would have been able to do in a shop, for example - or the intended use of the goods.
The freight charges for the return sending has to be covered by the customer. Ihn case of a legitimated claim the value of the goods and the freight charges will be reimbursed.
The right of withdrawal is valid unless other conditions agreed , not in case of dictate contracts
4. Prices and shipping conditions
4.1. The prices that were displayed on the website at the time of the order apply. Waldis-fellshop.at reserves the right to correct obvious errors at any time.
4.2 Packaging and shipping costs, which are generally payed by the customer, are added to the prices.
4.3 The goods are generally dispatched against prepayment, by means of an advance transfer to the account notified to the customer or the selected payment option from PAYPAL.
4.4 The goods are only delivered as an insured package. waldis-fellshop.at reserves the right to choose the logistics partner.
5. Delivery and Freight Conditions
5.1 The goods will be dispatched 2-3 days after receipt of the full purchase price plus any delivery and shipping costs at waldis-fellshop.at.
5.2 The customer assures that he has entered the correct and complete delivery address. Should there be additional costs for the dispatch due to incorrect address data - such as new shipping costs or costs for returned direct debits - the customer must reimburse them.
5.3 If the customer purchases several items at the same time there is the option of a single dispatch, if the customer so desires; however, there is no entitlement to such a dispatch.
5.4 If the delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the employee of the transport service provider who is delivering the item. Failure to make this complaint does not, however, affect your legal claims.
5.5 Unless otherwise agreed, the costs for returns are to be reimbursed by the buyer.
5.6 We ask for your understanding that if the return period ( of the 14 days after receipt of the goods ) is exceeded, no refund can be made.
6. Retention of title
In case Walldis- fellshop.at has to exchange the goods for whatever reason, the following agreement will be made:
that ownership of the goods to be exchanged is mutually transferred from the customer to waldis-fellshop.at or vice versa at the time when waldis-fellshop.at receives the goods from the customer or the customer receives the exchange delivery from waldis-fellshop.at receives.
Immediately after receipt of the goods, entrepreneurs must notify waldis-fellshop.at of obvious defects in the goods in writing or in text form, otherwise the assertion of the warranty right is excluded. Timely dispatch of the notification of defects is sufficient to meet the deadline. In the case of entrepreneurs, waldis-fellshop.at initially provides a guarantee or a replacement delivery for defects in the goods at its own discretion.
According to the statutory provisions, waldis-fellshop.at is liable for intent and gross negligence as well as in the event of a breach of an essential contractual obligation (cardinal obligation).
The waldis-fellshop.at is liable, limited to the replacement of the foreseeable contract-typical damage at the time of conclusion of the contract, for damage that is based on a slightly negligent breach of cardinal obligations by it or one of its legal representatives or vicarious agents.
Waldis-fellshop.at is not liable for slightly negligent breaches of secondary obligations that are not cardinal obligations.
Liability for damage that falls within the scope of a guarantee or assurance given by waldis-fellshop.at as well as liability for claims based on the Product Liability Act and damage resulting from injury to life, body or health remains unaffected.
9.1 Waldis-fellshop.at will observe all data protection requirements, in particular the provisions of the Teleservices Data Protection Act.
9.2 Otherwise, the statutory provisions apply.
9.3 If individual provisions of the sales contract or these general terms and conditions are ineffective, the remaining provisions remain in effect. Austrian law applies to cross-border delivery traffic.
9.4 If the customer is a merchant, the place of jurisdiction for all disputes arising from the contractual relationship is the seat of waldis-fellshop.at.
